1. Introduction

These Terms of Sale ("Terms") govern the sale of products through our e-commerce website BEARBUY 熊購 [https://bear-buy.com/] (the "Site"), operated by [BEAR CREATIVITY TECHNOLOGY DEVELOPMENT COMPANY], registered in Hong Kong at [Unit B, 11/F, Wah Lik Industrial Centre, 459-469 Castle Peak Rd, Tsuen Wan]. By purchasing, you agree to these Terms.

2. Orders

Orders are offers to purchase. We may accept or reject. Binding upon our confirmation.

3. Products and Pricing

Products as described. Prices in HKD priority; others include taxes. We may change prices or correct errors.

4. Payment

We accept [e.g., Visa, MasterCard, American Express, Alipay, WeChat Pay, HK FPS]. Secure processing. Full payment required at order.

5. Shipping and Delivery

We ship to Hong Kong and specified regions (including international). Delivery times are estimates. Risk passes to you upon delivery.

6. Returns and Refunds

6.1 Customers must request returns and refunds within 36 hours of receiving goods (time calculated from courier confirmation of receipt). Before opening the box/bag, use a recording device (e.g., phone) to provide evidence via unmodified video, sent to our email or WhatsApp.

6.2 If 6.1 is met and goods are found counterfeit, returns are allowed per Hong Kong consumer laws. Refunds to original payment method (within approx. 5 working days).

6.3 If payment is made and goods not shipped within 24 hours, refunds can be requested per Hong Kong consumer laws. Refunds to original payment method (within approx. 5 working days), and the order will be cancelled.

7. Warranties

Products "as is." Manufacturer warranties apply. No implied warranties beyond Hong Kong laws.

8. Limitation of Liability

We are not liable for indirect damages. Liability limited to purchase price, subject to Hong Kong laws.

9. Governing Law

Governed by Hong Kong laws. Disputes resolved in Hong Kong courts.

10. Changes

We may update the Site at any time (e.g., product prices, quantities, information). Continued purchase constitutes acceptance.

11. Force Majeure

If any party fails or delays in performing any obligations under these terms and conditions, and such failure or delay is due to any cause beyond the reasonable control of that party (including but not limited to natural disasters, civil or military actions, labor disputes, fire, riots, civil unrest, sabotage, war, embargo, blockade, boycott, flood, epidemic, transportation delays or government sanctions), and has notified the other party accordingly, the time for performance of that party's obligations shall be extended accordingly. If the relevant situation persists for more than three months, both parties shall conduct good faith discussions to mitigate the impact of the situation or reach a fair and reasonable alternative agreement.

6.1 客戶需要收取貨品後36小時內提出退貨及退款 (時間計算由快遞公司確認客戶收取貨品起)，請開箱/袋前使用有錄影功能的工具(例如:手機)提出證據，沒有任何修改的影片/視頻, 發送至我們電子郵件或whatsapp。

6.2 必須符合6.1條件，客戶發現我們送遞的貨品是冒牌貨，可以進行退貨，符合香港消費者法例。退款至原付款方式 (大約5天工作日內)。

6.3 如客戶付款後，而且我們在24小時內還未寄出貨品，客戶可以提出退款，符合香港消費者法例。退款至原付款方式 (大約5天工作日內)，訂單也會取消。

7. 保證

產品「現狀」。製造商保證適用。無超出香港法例的默示保證。

8. 責任限制

我們不對間接損害負責。責任限於購買價，遵從香港法例。

9. 適用法律

受香港法律規管。爭議於香港法院解決。

10. 變更

我們可以隨時更新網站(例如:產品價錢、數量、資訊等)。繼續購買即表示接受。

11. 不可抗力

倘若任何一方未能或延遲履行任何本條款及條件下之責任，而該不履行或延誤是由於任何超出該方合理控制下之原因(包括但不限於天災、民事或軍事行為、勞資糾紛、火災、暴動、民間騷動、破壞、戰爭、禁運、阻塞、抵制、水災、瘟疫、交通延誤或政府制裁)，並己因此而通知另一方，該方責任之履行時間將被相應地延長。倘若有關情況持續多於三個月，雙方須進行善意討論務求減輕有關情況之影響或達成公平及合理的替代協議。
